Kord LLC works with aggregates and knows from its own experience how expensive trust without verification can be. We publish the official information about the search and explain what we have changed in the way we work.

What is known about the case

The Criminal Investigation Department of the Main Directorate of the Ministry of Internal Affairs of Russia for the City of Moscow is searching for Korolkova Elena Evgenievna, born 28 July 1973, who has absconded from the investigation. She is charged with an offence under Part 4 of Article 159 of the Criminal Code of the Russian Federation — fraud on an especially large scale — has been remanded in custody in absentia by a court and placed on the international wanted list.

Criminal case No. 12301450005000320 of 17.03.2023 is conducted by the Special Investigative Unit for the Investigation of Organised Criminal Groups, Investigative Directorate, Ministry of Internal Affairs for the Southern Administrative District, Main Directorate of the Ministry of Internal Affairs of Russia for the City of Moscow; the measure of restraint was imposed in absentia by the Nagatinsky District Court of Moscow. The information about the search is published in the official wanted database of the Ministry of Internal Affairs of Russia: мвд.рф/wanted — anyone can verify it by entering the surname, first name, patronymic and year of birth.

Guilt is established only by a court judgment that has entered into legal force. At the time of publication the person has the status of an accused; the criminal case has not been considered on the merits.

What we now check before signing a contract

  1. We compare the bank details down to the last kopeck. The name, INN and KPP in the contract must match the extract from the Unified State Register of Legal Entities (EGRUL). If even one digit of the INN differs, the conversation is over.
  2. We look at who signs and who owns. A recent registration plus a director listed in dozens of other companies is a reason to request documents and meet in person.
  3. We check debts. The Federal Bailiff Service database of enforcement proceedings and the arbitration court case files show whether the company pays its obligations. Recent claims by suppliers are the most honest indicator.
  4. We read the registers in full. An entry about unreliable information in the EGRUL and inclusion in the register of unscrupulous suppliers settle the matter at once.
  5. We do not pay third parties. If the supplier in the contract is one company but the invoice is issued to another organisation or to an individual, we refuse the deal.
  6. We split the advance payment. We transfer a large sum in stages, for the batches actually shipped, and close each shipment with separate documents.

We have put together the full twelve-point checklist together with colleagues — it is published on the main site.

If the advance payment has already been transferred and there is no delivery

  1. Collect the evidence: the contract, invoices, payment orders, correspondence, transport documents, reconciliation statements.
  2. Send a written pre-action claim by registered letter with a list of attachments and with acknowledgement of receipt — to the legal address from the EGRUL.
  3. File a report with the police: 102, 112 or the territorial department at the place where the act was committed. Attach copies of the documents and state the amount.
  4. File a claim with the arbitration court and at the same time ask for interim measures — the arrest of the defendant's accounts and property.
  5. Check whether insolvency proceedings against the debtor are pending and make sure you meet the deadline for inclusion in the register of claims.
